Terms of Use — Singularety
Overview
These Terms of Use (the "Terms") govern your access to and use of the Singularety mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
Important note: The Service does not provide any cryptocurrency wallet functionality and does not enable sending, receiving, holding, or transferring Bitcoin, Lightning, or any other cryptocurrency within the App.
1. Eligibility
You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this requirement and that you will comply with these Terms and applicable laws.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate information and to keep it updated. We may suspend or terminate accounts that violate these Terms, our Community Guidelines, or applicable law.
3. The Service and Safety
The Service provides location-based discovery, group chats, and event discovery features. Interactions may occur online and offline (for example, meeting at events). You are solely responsible for your interactions with other users. We do not conduct background checks. Use caution when communicating off-platform or meeting in person, and do not share sensitive information. We are not responsible for the conduct of users, whether on or off the Service.
4. User Content and UGC Rules
4.1 Your content
You are responsible for the Content you create, upload, send, or share through the Service. You represent that you have the rights to your Content and that it does not violate law or third-party rights.
4.2 License to operate the Service
To operate and improve the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable (to Service Providers), and transferable license to host, store, reproduce, modify (for formatting and technical processing), distribute, display, and perform your Content solely in connection with providing, maintaining, and improving the Service and enforcing these Terms. This license ends when your Content is deleted from our systems, except where (a) your Content has been shared with others and they have not deleted it, or (b) we must retain certain information for legal, security, safety, or dispute resolution purposes.
4.3 Community Guidelines (prohibited content and conduct)
You agree not to:
- post or share illegal content or use the Service for unlawful purposes;
- harass, bully, threaten, stalk, or defame others;
- post sexually explicit content, child sexual abuse material, or content that exploits or endangers anyone;
- incite violence, promote hate, or encourage self-harm;
- impersonate others or misrepresent your identity;
- share someone else’s personal information without permission;
- spam, scam, or solicit money, gifts, or items of value from other users;
- upload malware or attempt to interfere with the Service’s security or operation.
4.4 Reporting and blocking
The Service provides tools to report Content and to block users. You agree to use these tools responsibly. We may remove Content or restrict accounts when we believe it is necessary to enforce these Terms or protect users.
5. Intellectual Property
The Service, including its software, design, trademarks, and content provided by us, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law or with our written permission.
6. Subscriptions and Purchases
6.1 Google Play & Apple Pay billing
Subscriptions and in-app purchases (if offered) are processed through Google Play and Apple Pay respectively. Prices, billing periods, and renewal terms are displayed at purchase.
6.2 Auto-renewal and cancellation
If you purchase an auto-renewing subscription, it will renew until you cancel. You must cancel through Google Play and Apple Pay subscription settings before the renewal date to avoid being charged for the next period.
6.3 Deleting the app or account
Deleting the app or deleting your account does not automatically cancel your subscription. You must cancel via Google Play and Apple Pay.
6.4 Refunds
Refunds (if any) are handled according to Google Play’s & Apple Pay policies and applicable law. Except where required by law, purchases may be non-refundable.
7. Termination
You may stop using the Service at any time. You may request deletion of your account in the app settings. We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, our policies, or applicable law, or if it is necessary to protect the Service or other users. Where appropriate, we may provide notice.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any Content will be accurate or suitable for your purposes.
9. Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service, including interactions with other users or attendance at events. To the extent liability cannot be excluded, our aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to us for the Service in the 12 months before the event giving rise to the claim, or (b) INR 1,000.
10. Indemnity
You agree to indemnify and hold us and our affiliates, directors, officers, employees, and Service Providers harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your violation of these Terms or applicable law.
11. Governing Law and Jurisdiction (India)
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to applicable law, courts located in Haryana, India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms in the App and/or on our website and update the "Last updated" date. If changes are material, we will provide additional notice as required by law. Continued use of the Service after the changes become effective means you accept the revised Terms.
